Terms of Service
These terms are an agreement between you and Nicholas Samuelson (“we,” “us,” or “Lacuna”) about your use of the Lacuna service. Using Lacuna means you agree to them. If you do not, do not use the service.
1. Who we are
Lacuna is a project by Nicholas Samuelson, based in Calgary, Alberta, Canada. It is not yet incorporated. Contact: nicholas.samuelson@ucalgary.ca.
2. What Lacuna is and isn’t
Lacuna is an educational analytics tool that combines review outcomes from Anki and, optionally, answered clinical cases from question banks, maps each learning object to a structured topic and objective, and looks for repeated concept-level patterns.
It is not medical advice, not a diagnostic tool, and not a validated measure of competence or clinical readiness. You must not rely on Lacuna to make patient-care decisions.
3. Beta status
Lacuna is in beta. Features may change. Data may occasionally be lost during migrations, though we take reasonable steps to avoid it. We may add, modify, or remove features at any time.
4. Your account
You are responsible for keeping your credentials safe. One person per account. If you believe your account has been compromised, contact us and change your password immediately.
5. Acceptable use
You agree not to:
- Scrape, mirror, or resell the service or the data it produces.
- Use the service to attempt to identify individuals from patterns in the data.
- Upload or transmit material you do not have the rights to use.
- Interfere with or attempt to compromise the service’s security.
- Use the service to violate any law, or the rights of any person or institution.
6. Plans and payment
Beta plans are free. When paid plans launch, prices and terms will be published before enrolment, and you will not be charged without providing explicit consent to a specific plan.
7. Third-party services
Lacuna relies on Supabase, Vercel, Railway, and (optionally, when you enable it) OpenAI. Their terms apply to the parts of the service they provide. Lacuna is not responsible for the acts or omissions of these providers.
8. Termination
You may delete your account at any time. We may suspend or terminate your account if you violate these terms, if we are required to by law, or if we discontinue the service. We will make reasonable effort to give notice before terminating for any reason other than a material violation of these terms.
9. Disclaimer
Lacuna is provided “as is,” without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, suitable for exam preparation, or fit for any particular purpose. Any analysis, score, or focus area Lacuna surfaces is an educational heuristic, not a validated measure.
10. Limitation of liability
To the maximum extent permitted by law, Lacuna’s total liability to you for any claim arising from these terms or your use of the service is limited to the amount you paid us in the 12 months before the claim arose (which, during beta, is zero). We are not liable for indirect, consequential, incidental, or punitive damages.
11. Governing law
These terms are governed by the laws of the Province of Alberta, Canada, and the federal laws of Canada applicable in it. You and we agree to the exclusive jurisdiction of the courts of Alberta for any dispute arising from these terms, except that either party may seek injunctive relief in any court of competent jurisdiction.
12. Changes to these terms
We may change these terms. If we make a material change, we will notify you by email at least 14 days before it takes effect. Continued use of the service after the change takes effect means you accept the new terms.
